Regular Session Council Meeting
Mayor Hall called the meeting to order at 5:30 p.m.
Present were Mayor Hall, City Attorney Kevin Barham, Clerk Eveld, Alderpersons Anderson, Flanary,
Meeker, Melton and Nicely. Holman was absent due to a family commitment.
First Anderson, Chair of Personnel and Policy Committee reported that they had met and finished work
on the personnel and Policy handbook. He said the police department had some issues with the way
raises were secured and Anderson said they needed to hear those concerns and revisit that in the policy.
Water Superintendent Cecil Zollliecoffer reported that he had two quotes for the material to do the
repairs on the tanks and the low bid was Bryce Carter at winwaterworks and came in at $15,601.68. a
motion was made by Melton to accept the low bid seconded by Nicely. On a roll call vote, the following
voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
Cecil also said he needs to replace the water lines on Hillbilly Loop and has been doing line locates, and
the cost will be paid out of his construction fund. He also reported that he will be getting an employee
from WAEDA at no cost to the city.
Next Chief Bramlett reported for the police department that there had been 44 arrests, 82 reports
written, and 12 accidents worked. He said several classes are lined up to be hosted by the Ozark Police
Department for 2020 and the facility is appreciated.
Street Superintendent Sampley reported that the cemetery software should be ready by December 1 st .
Melton also noted that several streets had been paved. Sampley said once the state approves the plans
for the sidewalks project, bids can be opened for that.
Fire Chief Trotter reported that the new SCBA’s were in and brought one in for a demo. He said a
thermal imager was build in for the safety of citizens and firefighters. He also said they would be doing
some training on those at the old pool building tomorrow night at 6:30 if any council member would like
to see the training.
He reminded citizens that only yard waste is allowed for burning in the city and a fine or warning would
be issued if anything other than what is grown in your yard is burned.
Mayor Hall reported that the letter in council packets is just for council review and notation in minutes
that Melanie Phillips will be replacing Art Timmerman on the Housing Commission. Oct 1, 2021 will be
the term length for her.
New Business:
Mayor Hall asked council to approve a few line items to be added to new business:
- Resolution for walking Track
- New member for A & P
- 2020 Proposed Budget
- Personnel Policy Ordinance Update regarding Sick time
- Retirement for the City Clerk
First a motion to read resolution 2019-27 to be read was made by Nicely seconded by Melton. This
resolution is an agreement for funding to the senior center by the Ozark city council. On a roll call vote,
the following voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
Attorney Barham read Resolution 2019-27. A motion to adopt was made by Anderson seconded by
Meeker. On a roll call vote, the following voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely.
No Nays.
Kelly Hopkins with Area Agency had sent a letter requesting funding and council has those in their
packet. Mayor Hall said to call her with questions or concerns.
Main Street Chair Chris Brockett reported on the project completed in the last year by main street and
projected projects for 2020. He stated that the city pays $30 to fund Main Street but gets back over
$42K in volunteer hours.
Sara Rodriguez reported on behalf of the Chamber as their interim director, and said they went over
slightly but only because some of the funds spent were left over from 2018. Christmas on the Square
was coming up and will be all free to citizens. She asked when the deadline to turn in receipts would be
and Mayor Hall said December 20 th .
Next council discussed the 219 Christmas Bonuses. The total for 219 would be $5,400. Melton made a
motion to give out $100 to each full-time employee and $50 to part time employees, seconded by
Nicely. On a roll call vote, the following voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No
Nays.
Next council was told that the walking trail needs padding. The application for a grant was denied so
mayor Hall will be seeking another grant and needs council approval to apply. The cost would be
$42,852.00. a motion to read resolution 2019-26 was made by nicely seconded by meeker. On a roll call
vote, the following voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
Kevin Barham read 2019-26 for the mayor to apply for a walking track padding grant. A motion to
approve was made by Anderson seconded by Flanary. On a roll call vote, the following voted: AYE:
Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
A & P new member recommendation is John Reynolds, owner of the Oxford Inn. A motion to approve
the recommendation was made by Anderson, seconded by Nicely. On a roll call vote, the following
voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
Mayor Hall noted that council has in their hands the 2020 proposed budget. The budget committee will
meet again on Monday at 5:30 and discuss salaries.
Next the Personnel Policy regarding sick time was brought to council in Ordinance 2019-25. A motion to
read was made by Nicely, seconded by Melton. On a roll call vote, the following voted: AYE: Anderson,
Flanary, Meeker Melton, and Nicely. No Nays.
Barham read Ordinance 2019-25. A motion to suspend second and third reading and read by title only
was made by Flanary seconded by Anderson. On a roll call vote, the following voted: AYE: Anderson,
Flanary, Meeker Melton, and Nicely. No Nays.
Barham read Ordinance 2019-25 by title. A motion to approve was made by Flanary seconded by
meeker. On a roll call vote, the following voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely.
No Nays.
A motion to accept emergency clause was made by Flanary seconded by Meeker. On a roll call vote,
the following voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
Last was the City Clerk Retirement. Kevin Barham presented that he had been approached several
months ago that the clerk would like to have approval by council to use her employment with the
Water Department towards her retirement vesting period. She served five years with the water
department and has served 9 years with the city as city clerk. Barham explained that the guidelines
for city clerk retirement is set by state statute. She will receive half her salary for life upon reaching
60 years of age and having served 10 years. Kevin prepared a resolution stating she had met the state
statute requirements if the council approved the water department years of service. A motion to read
resolution was made by Anderson seconded by Flanary. Kevin read resolution 2019-28. Mayor Hall
asked for a motion to approve. Nicely said that she had a phone call from an anonymous person
saying that the clerk had made mistakes. She said that she and the council members beside her felt
that granting retirement would be rewarding those mistakes. Meeker said he would hold his tongue
because he didn’t want to be ugly. Anderson motioned to table for further research. Meeker
seconded the motion. On a roll call vote the following voted: AYE: Anderson, Meeker. NAY: Flanary,
Melton, and Nicely. Motion was denied to table. Barham asked for a recess to research the law. A 10
minutes recess began at 6:43 p.m.
Council returned at 6:50 p.m. A motion to approve Resolution 2019-28 was made by Melton
seconded by Flanary. On a roll call vote, the following voted: AYE: Anderson, Flanary, Meeker Melton,
and Nicely. No Nays.
Mayor Hall then reported that Russ Workman donates the awards for employee of the month, and she
thanked him for that. The employees of the month are:

Public Input:
Kevin Eveld addressed the council and stated that the only person who has never made a mistake was
Jesus Christ and that in this great country people are innocent until proven guilty. He wanted to stress
that the city clerk is leaving because she wishes to retire and no other reason. He said the city clerk
handled over $13 Mission dollars in 2018 and as indicated by the audit, zero money has ever been
missing.
Mayor Hall noted that city offices would be closed in observance of thanksgiving Thursday and Friday of
Thanksgiving week.
The community center would be closed Thursday.
A motion to adjourn was made by Anderson seconded by Melton. On a roll call vote, the following
voted: AYE: Anderson, Flanary, Meeker Melton, and Nicely. No Nays.
