MINUTES OF THE REGULAR MEETING
OF THE OZARK CITY COUNCIL
February 8, 2021
Ozark city Council Meeting Room
The Regular Meeting was called to order by Mayor Roxie Hall and upon a roll call, a quorum was declared to exist for the meeting. Present were Alderpersons Rex Anderson, Rusty Cagle, Brandy Flanary, Charlie Meeker, and Randy Melton. Alderperson Susan Holman was absent. Rex Anderson led the Invocation and Rusty Cagle led the Pledge of Allegiance.
Charlie Meeker made a motion to approve the Minutes of the January meeting, seconded by Rusty Cagle. Upon a roll call, all alderpersons voted aye and the Minutes were approved. Rex Anderson then made a motion to approve the Financial Reports, seconded by Randy Melton. Upon a roll call, all alderpersons voted aye and the Financial Reports were approved. Under Departmental Reports it was noted that the Police Department hired one new officer. The Code Enforcement position will be changed to a Ward assignment. Each ward will have 2 officers assigned to cover the area. Officer Grant Nicely will be overseeing these assignments. The Fire Department will be hosting an Open House Thursday, February 11, from Noon until 6: 00 p.m. at the new Fire Station# 3.
A motion was made by Rex Anderson to add Ordinance 2021- 4 ( Amending the Personnel Handbook) to the Agenda, seconded by Randy Melton. Upon a roll call, all alderpersons voted aye and next a motion to read Ordinance 2021- 4 was made by Randy Melton and seconded by Rusty Cagle with all alderpersons voting aye. City Attorney Kevin Barham then read the proposed Ordinance. A motion to dispense with the 2ndand 3′ dreading and vote by title only was made by Charlie Meeker and seconded by Rusty Cagle. All alderpersons voted aye. A motion to proceed with the Emergency Clause was made by Charlie Meeker, and seconded by Randy Melton. All alderpersons voted aye. A motion to approve was made by Randy Melton and seconded by Brandy Flanary. All alderpersons voted aye and Ordinance 2021- 4 was approved.
A motion was made by Rusty Cagle to add Resolution 2021- 3 ( concerning property located at 218 W. Commercial) to the Agenda, seconded by Randy Melton. All alderpersons voted aye. A motion was made by Rusty Cagle to have the Resolution read, seconded by Brandy Flanary, with all alderpersons voting aye. City Attorney Kevin Barham then read the Resolution. A motion to approve was made by Rex Anderson and seconded by Rusty Cagle. Upon a roll call, all alderpersons voted aye and Resolution 2021- 3 was approved.
A motion was made by Charlie Meeker to add Resolution 2021- 4 ( concerning property located at 2307 W.Main)) to the Agenda, seconded by Rex Anderson, with all alderpersons voting aye. A motion to read the Resolution was made by Rusty Cagle, seconded by Randy Melton, with all alderpersons voting aye. City Attorney Kevin Barham then read the Resolution.
A motion to approve was made by Rex Anderson and seconded by Rusty Cagle. Upon a roll call, all alderpersons voted aye and Resolution 2021- 4 was approved.
Under new Business, Mr. Bob Wright, of Crews & Associates, Inc. presented a handout detailing arefinancing plan for the Water& Sewer Bond. The Council agreed for Mr. Wright to proceed with refinance plan and return to the City Council meeting in March.
A motion to read Resolution 2021- 1 endorsing Butterball to participate in the Tax Back program was made by Randy Melton and seconded by Rusty Cagle, with all alderpersons voting aye. City Attorney Kevin Barham then read the Resolution. A motion to approve the Resolution was made by Rusty Cagle and seconded by Randy Melton. Alderpersons Anderson, Cagle, Flanary and Melton voted aye and Alderperson Meeker abstained. Resolution 2021- 1 was approved.
A motion to read Resolution 2021- 2 amending the 2020 Budget was made by Rex Anderson and seconded by Rusty Cagle, with all alderpersons voting aye. City Attorney Kevin Barham then read the Resolution. A motion to approve was made by Rusty Cagle and seconded by Charlie Meeker, All alderpersons voted aye and Resolution 2021- 2 was approved. Alderperson Meeker then questioned whether or not this Resolution covered the Water Department budget. Mr. Barham replied that it did not and we can cover that issue next month.
A motion to read Ordinance 2021- 3 covering COVID- 19 Leave policies was made by Charlie Meeker and seconded by Rusty Cagle. All alderpersons voted aye. City Attorney Kevin Barham then read the Ordinance. A motion to dispense with the 2nd & Yd reading and accept by title only was made by Randy Melton and seconded by Rusty Cagle. All alderpersons voted aye. A motion to approve the Ordinance was made by Charlie Meeker and seconded by Rusty Cagle. Upon a roll call, all alderpersons voted aye and Ordinance 2021- 3 was approved. A motion to enact the Emergency Clause was made by Rusty Cagle and seconded by Rex Anderson with all alderpersons voting aye putting Ordinance 2021- 3 into effect immediately.
Chris Brockett then presented a possible Ordinance which would allow restaurants in the City of Ozark to serve mixed drinks by the glass without having to obtain a permit as a private club. Businesses will still be required to comply with ABC requirements regarding licensing. He stated this will help to keep businesses and revenue in Ozark. Mayor Hall then turned the matter over to the Council members for discussion and consideration so we may revisit during March Council meeting.
The Annual Spring Clean is scheduled for the week of April 5- 10. Citizens need to bring a copy oftheir water bill when bringing items to the transfer station. They are planning on having a drop-offfor electronics. Please contact Mayor Hall regarding the elderly or others who need help with hauling items to the transfer station.
April 3, 2021 is the City-Wide Clean-Up. The Keeping Arkansas Beautiful organization will be providing trash bags on this day. More information to come.
The State of the City address was then presented by Mayor Roxie Hall.
Under Public Input, Mr. Richard Yarbrough spoke regarding property lines and access to his property. He also stated that speed bumps had been promised for several months and have as yet to be installed. He stated that this is endangering children as well as the elderly and disabled who live in the area and several mailboxes have been damaged.
As of this date, 33 businesses have not obtained and paid for their current business license.
