OZARK CITY COUNCIL REGULAR SESSION
December 12, 2016
5:30 p.m.
Mayor McNutt opened the council meeting at 5:30 p.m. Present: Mayor McNutt, Clerk Eveld, Attorney Jeff Phillips, Alderpersons Warden, Holman, Hall, Anderson, Vicars, and Waters.
Holman gave the invocation and the pledge was led by Vicars.
Hall motioned to approve the minutes and financial statements seconded by Warden. On a roll vote, the following voted: Aye: Holman, Hall, Anderson, Waters, Warden, Vicars. No Nays.

Department Heads:
Street Dept. Superintendent Jody Sampley reported College Street will be paved before the end of the year, but they’ve had some break downs that has slowed progress. He said that last month he was asked to get estimates from more than one source regarding repairing street lights and maintaining them. He has two and is asking for permission to take bids as the prices are over the $10,000 maximum. Hall made the motion seconded by vicars. On a roll vote, the following voted: Aye: Holman, Hall, Anderson, Waters, Warden, Vicars. No Nays. Gary Six quoted $3,172 just to do repairs and Signal Tek priced $12,811.25 but they also have a maintenance agreement, which will be included in their bid. Susan asked to see the agreement. The motion was amended to include the agreement. Jody is getting the Christmas lights turned on the 20th. Hall asked if bleachers would be available for the nursing home residents who were able to come and he said yes. Hall said the bleachers would be in front of the Methodist Church, and after the residents, what’s left will be available to the public.
Next Chief Eveld thanked everyone for working on the Halloween festivities and all who came.
New Business:
Jerry Moore was on the agenda next to discuss parking however he was absent.
Next John Strode from Ritter Communications wanted to address the council regarding commercial video feeds/Cable. He said he can provide to cellular towers and provides Fiber. They will not provide to Residential. Waters asked if he was asking for exclusive rights. He said no, and he will pay the going franchise rate. Susan asked if Jeff had looked over the ordinance Mr. Strode provided, and Jeff said it looked ok. Holman made a motion to read in entirety ordinance 2019-19 seconded by Hall. Jeff read 2016-19. The second and possible third reading by title only will be read at the December meeting.
Next Sudden Link rates were up for discussion. Jeff looked over the paperwork Sudden link sent us stating that their rates were going up. The city cannot have a voice in the rate increases because we do not have FCC certification. Anderson voiced concerns regarding Sudden link’s service. Victoria said that Sudden link has shown no interest in Ozark. No action was taken.
Next, Main Street gave their annual report and asked for funding as they have received in the past. Various committee members reported about how they have used funds over the past year. Andrea Romo reported on the Downtown Beautification project, Tyler McKinney reported about the memorials and various projects to raise funds, and attempts to draw people to the area. Ruth Hoffman spoke about the Trail of Tears and the museum.
Next Susan asked if there is a list of properties and pricing available for downtown buildings that are vacant, so people could have access to this information and might open businesses. Sandy Key said she thought she had materials that would cover that.
Next Planning Commission recommends a rezone from R1 to C2. Jeff read ordinance 2016-20. Jeff said it doesn’t need to be read multiple times because it is subject to change. Vicars made the motion to approve ordinance 2016-20 seconded by Hall. On a roll vote, the following voted: Aye: Holman, Hall, Anderson, Waters, Warden, Vicars. No Nays.
Next ordinance 2016-21 was read by Jeff as the Planning Commission recommends a second rezone from R1 to C2 for the Bank of the Ozarks. Hall made the motion to approve seconded by Anderson. Planning Commission recommends a rezone from R1 to C2
Next Mayor McNutt set the budget meeting for November 28th at 5:30 p.m. and a personnel meeting for the 28th at 5:00 p.m.
Next Chad Graham, the new incoming Chamber president took the podium and announced a new open door policy and a transparency that hasn’t existed before. He aims to stop bickering between organizations and hopes everyone recognizes we are all working for a common goal. He said that he is asking the council to consider funding the Chamber with $50,000. His goal is to stop asking struggling businesses to support the Chamber. Mayor McNutt said he feels relations have improved between organizations and said he wants to look over the budget before a decision is made regarding this request.
Next was public input. Mayor McNutt announced the holiday closing schedule and said he had received a letter from Greensource thanking Ozark residents for their efforts in recycling.
A motion to adjourn was made by Anderson, seconded by Hall. Chris Brockett then said the Marina project is needing a Cultural Survey, and Main Street is funding this.
Meeting adjourned at 6:35. p.m.

OZARK CITY COUNCIL SPECIAL SESSION, November 28, 2016
The Ozark City Council met in a special session on Tuesday, November 28th at 5:30 p.m. at Fire Station One to have a budget planning workshop. Present were Mayor McNutt, Clerk Eveld, Roxie Hall, Susan Holman, Rex Anderson, Victoria Vicars, Harvey Waters, and Chris Warden. Incoming Alderperson Brandy Flanary was also present. All department heads were also present as was Chad Graham from Walmart and Connie Las Schneider from the Media.
Mayor McNutt walked the council through line by line on the budget to see what to keep and what to cut or cull. Alderperson Hall recommended the council give the Chamber $50,000 and Main street $30,000 even though the anticipated revenues were short from the budgeted expenses by over $600,000.00. She stated that we have to do something different. Clerk Eveld voiced her fear for passing a budget with such a deficit. The council will look over the changes that were made and discuss it further before voting to pass the budget, even if it isn’t passed until the January meeting.
The meeting lasted for three hours. It adjourned at 9:30 p.m.
